Violation of these provisions may result in immediate suspension or termination of access.

 

4. ARTIFICIAL INTELLIGENCE (AI) SERVICES AND DISCLAIMERS

 

4.1 AI as a Business Support Tool

 

Wizcale’s AI-powered solutions are designed to enhance and optimize business operations. However, you acknowledge that:

• AI-generated recommendations do not replace human decision-making.

• AI models are continuously learning, and accuracy is not guaranteed.

• AI-driven automation should be configured and validated based on your business needs.

 

4.2 AI Compliance and Responsibility

• Wizcale aligns its AI practices with Singapore’s Model AI Governance Framework and applicable data protection laws across Southeast Asia.

• Users are responsible for ensuring that AI-generated insights comply with local business regulations.

• Wizcale is not liable for AI-driven business decisions made without human validation.

 

5. INTELLECTUAL PROPERTY RIGHTS

 

5.1 Wizcale Ownership

• All software, AI models, branding, trademarks, and website content remain the exclusive property of Wizcale.

• Users may not copy, modify, distribute, or reverse-engineer any part of Wizcale’s technology.

 

5.2 User-Generated Data

• You retain ownership of any business-related data provided when using our AI solutions.

• Wizcale only processes user data to deliver services and enhance AI capabilities.

 

6. PAYMENT, SUBSCRIPTIONS, AND CANCELLATIONS

 

6.1 Fees & Payment Terms

• Some Wizcale Services require a paid subscription or one-time fee.

• Payments are non-refundable, except as required by law.

• We may update pricing with prior notice to users.

 

6.2 Free Trials & Promotional Offers

• Free trials are subject to usage limits and may be withdrawn at any time.

• Discounts apply only during the specified promotional period.

 

6.3 Cancellation & Account Termination

• Users may cancel their subscription at any time via their account dashboard.

• Wizcale reserves the right to suspend or terminate accounts that violate these Terms.

 

7. DATA PRIVACY AND SECURITY

 

7.1 Compliance with Regional Data Protection Laws

 

Wizcale complies with:

• Singapore’s Personal Data Protection Act (PDPA)

• Malaysia’s PDPA (2010)

• Indonesia’s PDP Law (2022)

• Philippines’ Data Privacy Act (2012)

9. LIMITATIONS OF LIABILITY

• Wizcale does not guarantee uninterrupted or error-free AI automation.

• We are not liable for losses caused by:

• AI-generated errors, business disruptions, or automation failures.

• Unforeseen system downtimes, cybersecurity incidents, or external threats.

• Users misapplying AI-generated outputs without verification.

 

9.1 Maximum Liability

 

To the extent permitted by law, Wizcale’s total liability is limited to the amount paid for the service within the last 12 months or USD 100, whichever is lower.

 

10. TERMINATION & ACCOUNT SUSPENSION

 

Wizcale reserves the right to:

• Suspend or terminate accounts violating our AI governance and acceptable use policies.

• Remove accounts that fail to meet compliance requirements.

• Discontinue or modify services with prior notice.

 

Upon termination:

• Users lose access to all AI tools and services.

• Pending subscription fees remain payable.

• Wizcale may delete stored data, unless legally required to retain it.

 

11. GOVERNING LAW AND DISPUTE RESOLUTION

• These Terms are governed by the laws of Singapore, without regard to conflict of laws principles.

• Any disputes shall first be resolved through negotiation.

• If unresolved, disputes will be settled through arbitration under the Singapore International Arbitration Centre (SIAC).

 

12. CHANGES TO THESE TERMS

 

We may update these Terms to:

• Reflect new AI governance regulations or compliance requirements.

• Introduce new AI-driven features or changes in service offerings.

• Align with industry best practices for automation services.

 

Users will be notified of material updates via email or website announcements.
